The effect of the use upon the potential market for, or value of, the copyrighted work Uses that harm the copyright owner’s ability to profit from his or her original work are less likely to be fair uses. Courts have sometimes made an exception under this factor in cases involving parodies.” I argue that using one battle scene between the supporting characters that is roughly 45 seconds long out of an anime with 22 minutes of 24 episodes each can hardly harm the copyright owner’s ability to profit from the work, especially when this battle has relatively very little association to the main theme or plot of the work.
